1. Agreement between you and Alinto SA Nabazcal.com is a Web service operated by Alinto SA. These Terms of Use constitute a legal agreement between you (the User) and Alinto. You must accept without modification all of the terms, conditions, and notices contained in these terms of use. If you do not accept these terms of use in their entirety, you may not access or use the services of Nabazcal.com. 2. Duration of the contract of use The term of this Agreement shall be for the duration of all Services ; either party (User and Alinto) may terminate the Agreement at any time without prior notice. 3. Definition of services The "Nabazcal Web" service (http://www.nabazcal.com) offers the User an email address or "electronic mail box" accessible through a web browser, identified by a personal code and placed under the sole responsibility of the User, allowing the exchange of email messages and access to a Calendar service. The "Nabazcal Remote" service (POP3/IMAP4 access) allows the User of messaging software to retieve messages received at this address and send messages to correspondents through the Internet. The "Nabazcal Voice" service allows the User of a fixed-line or mobile phone, to listen to their email, answer in speech or send voice messages to other pre-defined correspondents. The "Nabazcal WAP" service allows the User with a WAP-compatible mobile telephone to retrieve messages received at this address and send messages to correspondents through a mobile network. 4. Evolution of services Alinto SA may wish to update or change the terms, conditions, and services from time to time. You understand that Alinto reserves the right to make these changes and that you are responsible for regularly reviewing these terms, conditions, and notices. All services are independent of one another and may be temporarily suspended by Alinto for technical reasons. 5. Cost of the service The service is offered free of charge to the User, once they have registered and connected to www.nabazcal.com. All costs relating to Internet access, WAP or communications costs shall be borne by the User under their sole responsibility Access to the "Nabazcal WAP" service is invoiced to the User by their fixed or mobile telecommunications services operator, usually at a cost proportional to the time spent; costs are usually detailed on the operator.s Web site. Alinto reserves the right to insert advertising messages within the messages forwarded by the service, and the User accepts that Alinto may send email messages on a regular basis in order to communicate information about Alinto.s and/or partner or third-party services. 6. Liability You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Content originated. This means that you, and not Alinto, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via the Service. Alinto does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content. You understand that by using the Service, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will Alinto be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Service. Alinto undertakes to take all reasonable measures to ensure the transmission and storage of messages and/or data through Alinto services; however, Alinto is released from any claim of harm resulting from any cause beyond its control, including, but not limited to, interruption of Alinto services resulting from a network failure on the part of any other operator, or failure of the message recipient.s equipment. Alinto is released from any claim of harm in the event of use of Alinto services contravening to these conditions of use, or in the event of loss or disclosure of messages and/or data transmitted or stored by Alinto services. 7. Rules of conduct of the User The User agrees to not use the services to intentionally or unintentionally violate any applicable French, European, local, state, national or international law. The User undertakes not to use the service for reasons that are illegal or contrary to morals or public policy, and shall be liable for any message posted by him through the Alinto services. The User understands that all information, data, text, software, music, sound, photographs, graphics, video, messages or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Content originated. The Subscriber agrees to indemnify and hold Alinto free and harmless from any liability, suit, or damage arising from or connected with the User's Unauthorized and/or illegal Activities. The User agrees not to use the Alinto services for promotional or advertising ends, or to send unsolicited / unauthorised bulk mail. Should the User use the Services repeatedly and deliberately to transmit commercial, pornographic or unsolicited bulk messages, Alinto reserves the right to terminate the User.s account and invoice the User for an amount proportional to the number of messages transmitted, notwithstanding prosecution. 8 . Nabazcal data The User authorizes the commercial or promotional use or transfer by Alinto of personal data communicated at the time of registration. If you do not agree with the use or transfer of your personal data, please contact, in writing, Alinto SA, 15, quai Tilsitt, 69002 Lyon, France; if you choose to do so, Alinto will be entitled to refuse access to certain parts or options of the Service. Alinto may provide non-personal statistical data to its partners. In accordance with French personal data protection legislation, the User has a right to access, modify or delete said data upon request to the above address. Alinto undertakes not to examine nor reveal the contents of the User.s private communications, except as required by law; these provisions are liable to change in order to conform with current legislation. 9. Quality of service The User acknowledges that the service is provided to him .as is., and that he uses the service at his own risk; any up- or downloading of data and/or support performed through the service is done so at the User.s risk, and may generate direct or indirect damage, such as caused by viruses or loss of data, the consequences of which will be the User.s sole responsibility. Alinto reserves the right, for reasons of maintenance and without prior notice, to temporarily suspend access to all or part of Alinto services. Unavailability of services creates no right to compensation from Alinto. Alinto may perform automatic deletion of inbound or outbound messages if the mailbox is not accessed for a continuous period of over 30 days, or when the volume of messages exceeds the maximum limit stated in the conditions of use, or when technical constraints require Alinto to undertake such action at its own discretion. The User should delete received messages on a regular basis. Should a mailbox become saturated as a result of the number or size of messages it contains, thus preventing reception of new messages, Alinto will be entitled to reject any incoming message without informing the User of their rejection. The User accepts that the various Alinto services shall be used according to their characteristics and specific technical features. This means that all messages may not be delivered to the User with the same quality of service and/or content, depending on the terminals used. 10. Termination The User may request cancellation of their email address and deletion of their mailbox in writing, to mailstop@nabazcal.com, specifying their email address and password. An email will be returned to the User, asking the identification question specified at the time of registration. Upon receipt of the correct answer, the mailbox and any messages stored therein will be deleted, with no possibility of recovery. Alinto reserves the right to terminate this agreement at any time and without offering any compensation of any kind to the owner of the mailbox for direct or indirect damage, in the following cases: illicit or fraudulent use, or failure to comply with the terms of the Agreement, resulting from the notification by other Internet Users that the owner of the mailbox is using said mailbox in an improper manner, or contrary to morals or public policy. Alinto may terminate the agreement at its sole discretion, with prior notice to the User. 11. Erroneous information The supply of erroneous personal information and subsequent non-delivery of this message will result in the immediate termination of the account, until the User supplies valid information. In this event, the User will have no claim to compensation, neither financial nor through extension of service duration. 12. Applicable law The interpretation, performance and/or termination of this Agreement shall be governed by French law. Should the parties fail to resolve any dispute amicably, they agree to submit any dispute arising out of the validity, interpretation, performance or termination of this Agreement to the exclusive jurisdiction of the Commercial courts of Lyon, France.
